Asset Protection: Court Denies Motions to Freeze Clients’ Property

The Grain Law Firm team has successfully defended the property rights of two Clients by demonstrating the groundlessness of the prosecution’s motions for the imposition of an asset freeze.

During the court hearings, the defense focused on the prosecutor’s failure to comply with the key criteria required to restrict an owner’s rights: the existence of a legal basis, the reasonableness and proportionality of the interference, and the potential use of the property as evidence.

The attorneys paid particular attention to the legality of the seizure of computer equipment and communication devices. It was proven that the prosecution had failed to provide evidence demonstrating the necessity of retaining the equipment for forensic examination or any direct link between the items and the circumstances of the offense.
