Verdict of Acquittal for a Physician

The Supreme Court has issued its final ruling in the case of our Client—a physician at LLC “Medical Center “SantaLen”, who was accused under Part 1 of Article 140 of the Criminal Code of Ukraine (improper performance of professional duties by a medical worker, which caused grave consequences for the patient). The Panel of Judges left the verdict of acquittal unchanged, confirming the complete innocence of the Client.

The legal basis for the acquittal was the court’s finding of an absence of the elements of a criminal offense in the physician’s actions. In shaping the legal positioning, the Grain Law Firm team pointed out significant procedural violations committed by the prosecution, particularly the violation of the right to defense due to the lack of specificity in the charges preferred. Furthermore, the court was presented with irrefutable evidence demonstrating the absence of a causal link between the medical worker’s actions and the consequences for the patient.

Courts of all three instances, including the Supreme Court, fully concurred with the attorneys’ arguments. The criminal prosecution has concluded with the total acquittal of our Client and the full restoration of her professional reputation.
