Court Denies Pretrial Restriction in an Official Misconduct Case
The Grain Law Firm team has secured the defense of its Client’s interests in criminal proceedings under Part 5 of Article 191 of the Criminal Code of Ukraine (misappropriation of property on an especially large scale through abuse of official position).
An investigator of the Investigation Department of the Main Directorate of the National Police in the Kyiv Region filed a motion to apply a pretrial restriction in the form of bail. However, during the court hearing, the defense presented exhaustive arguments regarding the complete groundlessness of the risks insisted upon by the prosecution. Having heard the positions of both parties, the investigating judge fully concurred with the attorney’s arguments that there were no grounds for applying any measure of procedural coercion.
The court dismissed the investigator’s motion in its entirety. The denial of a pretrial restriction at the initial stage of the proceedings confirms the effectiveness of the chosen defense strategy and highlights the lack of evidence that the Client engaged in actions that could compromise the criminal proceedings.
