Defense of Client Rights in Compliance with Procedural Time Limits

Restoration of the rights of a Grain Law Firm Client in a case concerning the unjustified imposition of procedural obligations. This case illustrates the vital importance of strict compliance with the time limits of criminal proceedings as a fundamental guarantee for protecting an individual’s rights.

Alina Davydova, Counsel and Attorney-at-Law at Grain Law Firm, demonstrated the groundlessness of the prosecution’s demands to re-impose obligations after their expiration. The defense’s position was based on the fact that the Criminal Procedure Code of Ukraine does not provide a mechanism for imposing obligations without the simultaneous application or modification of a pretrial restriction. The prosecutor’s attempt to initiate measures to secure proceedings that are not provided for by law was recognized by the court as unlawful.

The court denied the prosecutor’s motions, confirming the impossibility of re-restricting the Client’s rights outside the scope of statutory procedures. This successfully brought an end to the unjustified procedural pressure on the individual.
